By accessing and using Zosma AI's website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. You must be at least 16 years of age to use our services. By using our services, you represent that you meet this age requirement.

Zosma AI provides the following products and services:

• ZoAH (Zosma Agentic Harness) — an AI-powered business intelligence agent that connects to your databases and SaaS tools, answers questions in plain English, and delivers reports via WhatsApp and other channels.
• OpenZosma — an open-source platform for deploying hierarchical AI agents across organizations, built on Pi SDK and sandboxed by Nvidia's OpenShell, using Google's A2A protocol.
• Consulting & Support — implementation, onboarding, custom integration, and ongoing support services related to our products.

These services are provided "as is" and may be modified, updated, or discontinued at any time with reasonable notice.

ZoAH offers a free trial with the following terms:

• The free trial period is one (1) month from the date your account is activated.
• No credit card is required to start the free trial.
• There are no hidden fees during or after the trial.
• At the end of the trial, your access will expire unless you choose to subscribe to a paid plan. We will not automatically charge you.
• During the trial, you will have access to the full feature set of ZoAH as determined at the time of activation.
• We reserve the right to modify trial terms, features, or duration for future trial offers.

• You must provide accurate and complete information when registering for our services or submitting forms on our website.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• You must notify us immediately at info@zosma.ai if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

When you submit a form on our website and check the consent checkbox, you agree to receive communications from Zosma AI through the following channels:

• Email — for trial setup, service updates, responses to inquiries, and operational notifications.
• Phone — for trial setup, onboarding, and support.
• WhatsApp — for trial setup, report delivery (in the case of ZoAH), and ongoing service communication.

You may withdraw your consent at any time by contacting us at info@zosma.ai or by replying "STOP" to any WhatsApp message. Withdrawal of consent may affect our ability to provide certain services. The consent checkbox on our forms is mandatory — you must agree before submitting any form.

ZoAH and other Zosma AI services may integrate with third-party AI model providers selected by you or configured for your account. These may include, but are not limited to, OpenAI, GitHub Copilot plans, Anthropic, Google, and others.

When you use features powered by external AI models, your query data and relevant context are sent to the selected provider's API. Each third-party provider processes this data under their own terms of service and privacy policy. Zosma AI disclaims responsibility for how third-party AI providers handle, store, retain, or process your data.

You are responsible for reviewing and accepting the terms and privacy policies of any third-party AI provider used in connection with our services. You acknowledge that data sent to third-party AI providers may be subject to their own data retention practices.

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to our systems, other users' accounts, or connected data sources beyond your authorized permissions.
• Transmit malware, viruses, or any other malicious code through our services.
• Use our services to harass, abuse, or harm others.
• Misrepresent your identity or affiliation when using our services.
• Use automated systems (bots, scrapers) to access our services beyond authorized API usage.
• Resell or redistribute our services without explicit written permission.

When using our APIs or integration services, you agree to:

• Follow our rate limiting guidelines and usage quotas.
• Not attempt to reverse engineer, decompile, or disassemble our services or APIs.
• Keep your API keys secure and confidential.
• Not use automated systems to extract data beyond your permitted usage scope.
• Not circumvent any access controls, authentication mechanisms, or security measures.

All content, trademarks, logos, and intellectual property on this website and in our proprietary products (including ZoAH) are owned by Zosma AI unless otherwise stated. You may not reproduce, distribute, modify, or create derivative works from our proprietary services without explicit written permission.

The OpenZosma platform is licensed under the Apache License 2.0. Your use of OpenZosma is governed by that license in addition to these terms.

You retain ownership of all data you provide to our services, including database connections, queries, and business data. By using our services, you grant Zosma AI a limited, non-exclusive license to process your data solely for the purpose of providing and improving the services you have requested.

We do not use your proprietary business data to train AI models or share it with other customers. Your data remains yours.

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. By using our services, you acknowledge that you have read and understood our Privacy Policy.

Our services integrate with or rely on the following third-party services. Your use of these services is subject to their respective terms:

• Google reCAPTCHA v3 — for form security and spam prevention. Subject to Google's Terms of Service.
• Resend — for transactional email delivery.
• Cal.com — for meeting scheduling. Data you provide when booking is processed under Cal.com's terms.
• Vercel — for website hosting.

Zosma AI is not responsible for the availability, accuracy, or practices of any third-party service.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-generated responses, insights, and reports may contain errors or inaccuracies. Zosma AI does not guarantee the accuracy, completeness, or reliability of any AI-generated output. You are responsible for verifying AI-generated results before making business decisions based on them.

To the maximum extent permitted by applicable law, Zosma AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses, whether incurred directly or indirectly, arising from your use of or inability to use our services. Our total cumulative liability for all claims arising from or related to these terms shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or USD $100.

You agree to indemnify, defend, and hold harmless Zosma AI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of our services, your violation of these terms, or your violation of any rights of a third party.

Either party may terminate access to our services at any time. You may stop using our services and request account deletion by contacting us at info@zosma.ai.

We may suspend or terminate your access if you violate these terms or engage in activity that we reasonably believe harms our services, other users, or third parties. Upon termination, your right to use our services ceases immediately. We will make reasonable efforts to allow you to retrieve your data before deletion, unless prohibited by law.

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts located in India.

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on this page and updating the "Last updated" date. For significant changes, we may also notify you via email. Your continued use of our services after such modifications constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using our services.
